Q: If I have a legal question to determine if a prior offense will make me ineligible to receive a license, to whom should I speak?

    A: The legal council @ the DPS (800-224-5744) along with your attorney. Instructors are strictly prohibited from offering any form of legal advice.

Q: Should I list all arrests on my application even if the cases were dismissed or I was found not guilty?

    A: Yes. Failure to disclose all of your arrests and convictions is an independent ground for your denial of your application.

Q: If I was arrested for an offense but the charges were dismissed, will my application be rejected?

    A: No. Dismissals will not be grounds for denial, as long as you were not placed on probation or deferred adjudication prior to the dismissal.

Q: If I am a legal resident alien, can I get a license?

    A: Under federal law, aliens who have been admitted to the U.S. under a non-immigrant visa usually are not qualified to purchase a handgun and therefore do not qualify for a license. If you were not admitted under a non-immigrant visa, you may qualify.

Q: Who is eligible to receive a license?

    A: Anyone who has not received:

• A conviction, plea bargain, deferment or probation for a Class "A" or "B" misdemeanor in the past 5 years.
• A class "C" misdemeanor for disorderly conduct (Texas Penal Code, Section 42.01) in the past 5 years.
• A conviction for a crime of domestic violence
• And especially - a conviction or probation for any grade of felony will be a lifetime disqualification. New Law: students who have received deferred adjudication for a non-Title 5 felony can apply after a period of 10 years from the final disposition of the court case.

    Applicants must

• Be U.S. citizens (or at least resident aliens)
• Not be delinquent in the payment of state taxes
• Not default on student loans
• Not be delinquent on child support payments
• Be mentally competent
• Be capable of demonstrating safe gun handling
• Pay the licensing fee to the DPS
